01 Definitions
For the purposes of this Agreement, the following terms shall have the meanings ascribed to them below:
02 Eligibility and Account Registration
2.1 Age Requirements
You must be at least eighteen (18) years of age to create an Account and use this App. The App contains mature content including but not limited to intimacy tracking, sexual position suggestions, fantasy-related features, and adult relationship content. By creating an Account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this Agreement. We do not knowingly collect information from or direct the App to individuals under 18.
2.2 Account Creation
To access the App, you must register for an Account by providing a valid email address, a password of at least six (6) characters, and a display name. You are solely responsible for maintaining the confidentiality of your Account credentials, including any optional PIN you configure for additional app-level security. All activities occurring under your Account are your responsibility.
2.3 Account Security
The App provides optional PIN-based access protection stored locally on your device via AsyncStorage. While this provides a layer of convenience security, it does not constitute a substitute for strong password practices. You agree to: (a) provide accurate, current, and complete registration information; (b) maintain and promptly update your Account information; (c) maintain the security of your password and PIN; (d) notify us immediately of any unauthorized use of your Account; and (e) accept responsibility for all activities under your Account.
03 Partner Pairing and Shared Data
3.1 Pairing Mechanism
The App generates a unique Pair Code (format: VELUMA-XXXX) upon Account creation. Sharing this code with another registered User and having them enter it initiates a bidirectional pairing that links both Accounts. By initiating or accepting a pairing, you consent to sharing certain Account data with your paired partner, including your display name, profile photo, mood status, calendar events, connection point data, and any Content you transmit through the App's messaging and feature systems.
3.2 Shared Data Scope
Once paired, the following categories of data become accessible to both Paired Users: (a) encrypted messages and photographs; (b) mood signals ("Go Time" / "Romance" / "Beware" status); (c) calendar events including menstrual cycle tracking, date nights, and custom events; (d) connection points, streak data, and reef growth metrics; (e) love language assessment results; (f) Fantasy Vault mutual matches; (g) intimacy logs and analytics; and (h) relationship snapshots and milestone celebrations.
3.3 Unpairing
Either User may terminate a pairing at any time through the Profile settings. Upon unpairing: (a) the bidirectional link between Accounts is severed; (b) shared features become inaccessible; (c) encrypted Content may become permanently undecryptable as encryption keys are derived from the paired relationship; and (d) connection points, streaks, and reef data associated with the pairing may be lost. The Company is not responsible for data loss resulting from unpairing.
04 Encryption and Privacy Architecture
4.1 End-to-End Encryption
The App implements end-to-end encryption for messages, photographs, and position suggestions exchanged between Paired Users. Encryption keys are derived deterministically from the unique pairing relationship using HKDF key derivation (HMAC-SHA-256), and Content is encrypted with AES-256-GCM authenticated encryption, meaning only the two Paired Users can decrypt each other's Content. The Company does not possess, store, or have access to decryption keys. Data stored on Firebase servers is encrypted in transit and at rest in its encrypted form.
4.2 Encryption Limitations
While the App employs encryption to protect Content, no encryption system is infallible. You acknowledge that: (a) the encryption is designed to prevent unauthorized access, including by the Company, but absolute security cannot be guaranteed; (b) device compromise, malware, or physical access to an unlocked device may circumvent encryption protections; (c) screenshots, screen recordings, or external photography of displayed Content cannot be prevented by encryption alone; and (d) metadata (such as message timestamps and conversation existence) may not be encrypted.
4.3 Self-Destructing Content
Certain Content may be designated as self-destructing with a configurable TTL. Self-destructing messages use a "sealed" delivery mechanism wherein the content remains encrypted and hidden until the recipient explicitly opens it, at which point the TTL countdown begins. Upon expiration, the Content is deleted from the database. You acknowledge that: (a) the Company cannot guarantee that Content is irrecoverable from all device caches or backups after deletion; (b) the recipient may capture Content before expiration through screenshots or other means; and (c) screenshot detection alerts are best-effort notifications and do not prevent the act itself.
05 Screenshot Detection and Photo Protection
The App includes screenshot detection technology that attempts to notify the sender when a recipient captures a screenshot of shared photographs or self-destructing content. The App also implements screen capture prevention on photo viewing screens where supported by the operating system. You acknowledge that: (a) screenshot detection is a notification mechanism, not a prevention mechanism; (b) the system tracks and reports screenshot counts and timestamps to the Content sender; (c) screen capture prevention may not function on all devices or operating system versions; and (d) external cameras, secondary devices, or modified operating systems may circumvent these protections. The Company disclaims all liability for Content captured through screenshots or any other reproduction method.
06 AI Concierge Service
6.1 Nature of Service
The AI Concierge is a Premium Feature that provides AI-generated date planning suggestions, relationship advice, and venue recommendations powered by third-party AI language models and the Google Places API. Responses are generated algorithmically and do not constitute professional advice of any kind, including but not limited to medical, psychological, therapeutic, legal, or financial advice.
6.2 Usage Limits
The AI Concierge is subject to daily usage limits as determined by the Company, which may be adjusted at any time. Usage is tracked locally on your device and resets daily. The Company reserves the right to modify, restrict, or discontinue the AI Concierge feature at any time without prior notice.
6.3 Context and Data Sharing
When using the AI Concierge, contextual information including your display name, your partner's name, specified location, budget preferences, and your conversation prompt are transmitted to third-party AI service providers via Firebase Cloud Functions. This data is processed in accordance with our Privacy Policy and the respective privacy policies of our third-party service providers. The AI Concierge does not have access to your encrypted messages, photographs, or Fantasy Vault selections.
07 Intimate and Adult Content
7.1 Nature of Content
The App contains features designed for adult couples that include sexually explicit content, including but not limited to: (a) sexual position descriptions and suggestions transmitted through the encrypted messaging system; (b) the Fantasy Vault, which presents categorized sexual fantasies for mutual matching between Paired Users; (c) the Position Roulette game, which randomly suggests intimate positions; (d) intimacy logging and analytics tracking sexual frequency, ratings, and patterns; and (e) Deep Dive conversation prompts covering topics of a sexual and intimate nature.
7.2 Consent and Use
By using intimate features, you represent and warrant that: (a) you are at least 18 years old; (b) you are sharing intimate content only with a consenting adult partner; (c) any photographs shared through the App depict only consenting adults; (d) you will not use the App's intimate features to harass, coerce, or pressure your partner; and (e) you understand that mutual matching features (such as Fantasy Vault) only reveal selections when both partners have independently chosen the same item, preserving individual privacy until mutual interest is confirmed.
7.3 User-Generated Photographs
Photographs shared through the App are encrypted end-to-end and stored in encrypted form on Firebase servers. You are solely responsible for the photographs you share. You represent and warrant that any photograph you share: (a) depicts only yourself or has been shared with the full, informed consent of all depicted individuals; (b) does not depict minors in any capacity; (c) does not depict illegal activity; and (d) complies with all applicable laws regarding the creation, distribution, and possession of intimate imagery.
08 Menstrual Cycle and Health Tracking
The App provides menstrual cycle tracking functionality, including period start date logging, cycle length estimation, phase calculations (Menstrual, Follicular, Ovulation, Luteal), and fertility window approximations. This tracking is provided for informational and relationship planning purposes only. You expressly acknowledge and agree that: (a) cycle tracking data is NOT a substitute for professional medical advice, diagnosis, or treatment; (b) fertility window estimates are approximations and SHALL NOT be relied upon for contraception or family planning purposes; (c) the App does not claim FDA clearance or medical device status; (d) cycle data is shared with your paired partner to facilitate mutual awareness and support; and (e) you should consult a qualified healthcare provider for all health-related decisions.
09 Gamification and Connection Points
The App features a gamification system ("Connection Points") that awards points for couple engagement activities including daily check-ins, messaging, mood logging, game participation, calendar events, intimacy logging, and nudge completion. Points contribute to: (a) a shared Connection Reef visualization with growth categories (intimacy, communication, date nights, mood sync, daily care); (b) streak tracking with configurable grace days; (c) milestone achievements; and (d) relationship snapshot prompts. Connection Points have no monetary value, are non-transferable, cannot be redeemed outside the App, and may be reset upon unpairing. The Company reserves the right to modify point values, categories, and the gamification system at any time.
10 Push Notifications and Nudges
The App utilizes push notifications delivered through Expo Notifications and Firebase Cloud Messaging to alert you of new messages, mood changes, calendar events, and relationship nudges. Nudges are context-aware notifications that may be triggered by menstrual cycle phases, calendar events, time-based scheduling, or inactivity periods. You may customize nudge categories and timing through the Nudge Settings screen. Push notification permissions are managed at the operating system level and may be disabled through your device settings at any time. Disabling notifications may limit App functionality.
11 Premium Subscription and Payments
11.1 Free and Premium Tiers
The App offers both a free tier with core functionality and a Premium subscription tier with enhanced features. Premium Features are subject to change and may include: AI Concierge, Intimacy Analytics, Deep Dive game, Position Roulette, advanced Fantasy Vault matching, and Connection Reef visualizations.
11.2 Billing and Renewal
Premium subscriptions are billed through the Apple App Store or Google Play Store. Subscription pricing, billing cycles, and renewal terms are governed by the policies of the applicable platform. You are responsible for managing your subscription, including cancellation, through the platform's subscription management interface. The Company does not process payments directly.
Veluma Premium is an auto-renewable subscription offered monthly or annually at the price shown in the App before purchase. Payment is charged to your Apple ID or Google account when you confirm the purchase. Your subscription renews automatically at the same price and length unless you cancel it at least 24 hours before the end of the current period, and your account is charged for renewal within the 24 hours before the period ends. You can manage or cancel your subscription at any time in your device's App Store or Google Play subscription settings; cancelling stops future renewals and Premium stays active until the end of the period you have paid for.
11.3 Refunds
Refund requests are handled exclusively by the Apple App Store or Google Play Store in accordance with their respective refund policies. The Company does not issue direct refunds for in-app purchases or subscriptions.
12 Affiliate Links
The App may display affiliate links to third-party products and services, including intimacy products, travel, dining, and wellness offerings. When you tap such a link, it opens the third party's website in your device browser, and the Company may earn a commission if you complete a purchase, at no additional cost to you. These third parties are independent of the Company; their products, services, websites, and conduct are governed solely by their own terms and privacy policies. The Company makes no representations or warranties regarding any third-party product or service and disclaims all liability arising from your interactions or transactions with such third parties.
13 Acceptable Use Policy
You agree not to use the App to: (a) share, distribute, or create child sexual abuse material or any content depicting minors in a sexual context; (b) harass, stalk, threaten, or intimidate any person, including your paired partner; (c) distribute non-consensual intimate imagery ("revenge porn"); (d) engage in any illegal activity or facilitate the commission of crimes; (e) attempt to circumvent, disable, or interfere with the App's security features, encryption protocols, or screenshot detection systems; (f) reverse-engineer, decompile, or disassemble any portion of the App; (g) create multiple Accounts, impersonate others, or share Account credentials; (h) use automated systems, bots, or scripts to access the App; (i) interfere with or disrupt the App's servers, networks, or infrastructure; or (j) use the App in any manner that violates applicable local, state, national, or international law.
14 Intellectual Property
The App, including its design, code, graphics, animations (including the Animated Splash screen), game content, nudge content, love language assessment framework, position descriptions, fantasy vault categories, and all associated intellectual property, is owned by the Company and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms. You retain ownership of Content you create and submit, but grant the Company a limited license to process, encrypt, store, and transmit that Content as necessary to operate the App's features.
15 Disclaimers and Limitations of Liability
15.1 General Disclaimer
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. THE COMPANY DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
15.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR ACCESS TO, USE OF, OR INABILITY TO USE THE APP; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS OR ANY PERSONAL INFORMATION STORED THEREIN; (C) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE APP; (D) ANY BUGS, VIRUSES, OR OTHER HARMFUL CODE TRANSMITTED THROUGH THE APP; (E) LOSS OF ENCRYPTED DATA DUE TO UNPAIRING, ACCOUNT DELETION, OR SYSTEM FAILURE; (F) ACTIONS TAKEN BY YOUR PAIRED PARTNER, INCLUDING SCREENSHOTS OF ENCRYPTED CONTENT; OR (G) ANY CONTENT SHARED BETWEEN PAIRED USERS.
15.3 Relationship Disclaimer
The App is a relationship enhancement tool, not a substitute for professional relationship counseling, therapy, or medical advice. The Company is not responsible for any relationship outcomes, disputes, or damages arising from the use of the App or its features, including nudge content, AI Concierge suggestions, game content, or intimacy analytics insights.
16 Indemnification
You agree to defend, indemnify, and hold harmless the Company, its officers, directors, employees, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your violation of these Terms; (b) your Content; (c) your use of the App; (d) your violation of any third-party rights, including intellectual property or privacy rights; or (e) any dispute between Paired Users.
17 Termination
The Company may terminate or suspend your Account and access to the App immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms. Upon termination: (a) your right to use the App ceases immediately; (b) encrypted data associated with your Account may become permanently inaccessible; (c) connection points, streaks, and gamification data will be forfeited; and (d) the Company has no obligation to retain, return, or provide copies of your Content. You may terminate your Account at any time by unpairing from your partner and deleting your Account through Profile → Delete Account in the App settings, or by contacting us.
18 Governing Law and Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any dispute arising out of or relating to this Agreement that cannot be resolved through good-faith negotiation shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Suffolk County, New York. Each party shall bear its own costs, and the arbitrator's decision shall be final and binding.
19 Modifications to Terms
The Company reserves the right to modify these Terms at any time. Material changes will be communicated through the App via push notification, in-app notice, or email to the address associated with your Account. Continued use of the App after the effective date of modified Terms constitutes acceptance of those modifications. If you do not agree to the modified Terms, you must discontinue use of the App and delete your Account.
20 Miscellaneous Provisions
- Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Company regarding your use of the App.
- Severability. If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
- Waiver. The failure of the Company to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
- Assignment. You may not assign or transfer these Terms or your rights hereunder without the Company's prior written consent. The Company may assign its rights and obligations under these Terms without restriction.
- Force Majeure. The Company shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, epidemics, government actions, or failures of third-party infrastructure (including Firebase, Expo, or cloud service providers).
- Notices. Notices to you may be provided via email, push notification, or in-app messaging. Notices to the Company should be directed to the contact information provided below.
